altera a<a href=\"https:\/\/pesquisa.in.gov.br\/imprensa\/jsp\/visualiza\/index.jsp?data=01\/12\/2021&amp;jornal=515&amp;pagina=90&amp;totalArquivos=158\"> Resolu\u00e7\u00e3o ANTAQ n\u00ba 62, de 29 de novembro de 2021<\/a> e a<a href=\"https:\/\/pesquisa.in.gov.br\/imprensa\/jsp\/visualiza\/index.jsp?data=06\/06\/2022&amp;jornal=515&amp;pagina=147&amp;totalArquivos=276\"> Resolu\u00e7\u00e3o ANTAQ n\u00ba 75, de 02 de junho de 2022<\/a>.<\/p>\n<p class=\"dou-paragraph\" style=\"text-align: justify;\">A DIRETORIA DA AG\u00caNCIA NACIONAL DE TRANSPORTES AQUAVI\u00c1RIOS (ANTAQ), no uso da compet\u00eancia que lhe \u00e9 conferida pelo <a title=\"Art. 19. \u00c0 Diretoria compete: XXVII - analisar e classificar, quanto \u00e0 reversibilidade e indeniza\u00e7\u00f5es, os bens das concession\u00e1rias, bem como os investimentos autorizados e por elas realizados; \" href=\"http:\/\/pesquisa.in.gov.br\/imprensa\/jsp\/visualiza\/index.jsp?data=25\/08\/2014&amp;jornal=1&amp;pagina=3&amp;totalArquivos=132\">inciso XXVII do art. 19.<\/a> do Regimento Interno, com base no \u00a0<a title=\"IV \u2013 elaborar e editar normas e regulamentos relativos \u00e0 presta\u00e7\u00e3o de servi\u00e7os de transporte e \u00e0 explora\u00e7\u00e3o da infra-estrutura aquavi\u00e1ria e portu\u00e1ria, garantindo isonomia no seu acesso e uso, assegurando os direitos dos usu\u00e1rios e fomentando a competi\u00e7\u00e3o entre os operadores; \" href=\"http:\/\/legislacao.planalto.gov.br\/legisla\/legislacao.nsf\/Viw_Identificacao\/lei%2010.233-2001?OpenDocument\">inciso IV do art. 27<\/a> da\u00a0<a class=\"ancoraSei legisSeiPro\" href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/leis_2001\/L10233.htm\" target=\"_blank\" rel=\"noopener\" data-index=\"0\" data-norma=\"Lei10233\" data-normafull=\"Lei n\u00ba 10.233, de 5 de junho de 2001\">Lei n\u00ba 10.233<\/a>, de 5 de junho de 2001, considerando o que consta do Processo n\u00ba 50300.006171\/2022-50 e tendo em vista o deliberado em sua Reuni\u00e3o Ordin\u00e1ria de n\u00ba 560, realizada em 7 de mar\u00e7o de 2024, resolve:<br \/>\nArt. 1\u00ba Estabelecer crit\u00e9rios para identifica\u00e7\u00e3o do agente respons\u00e1vel pela armazenagem adicional de carga e pelos servi\u00e7os e custos decorrentes nas instala\u00e7\u00f5es portu\u00e1rias, de acordo com o previsto no <a title=\" Art. 6\u00ba A armazenagem adicional e outros servi\u00e7os prestados \u00e0s cargas n\u00e3o embarcadas em navio e prazo previamente programados nas rotinas de exporta\u00e7\u00e3o, bem como aqueles prestados \u00e0s mercadorias n\u00e3o entregues no prazo devido aos importadores ou consignat\u00e1rios na importa\u00e7\u00e3o, ser\u00e3o cobrados pela instala\u00e7\u00e3o portu\u00e1ria ou pelo operador portu\u00e1rio diretamente ao respons\u00e1vel pelo n\u00e3o embarque das referidas cargas. \" href=\"https:\/\/pesquisa.in.gov.br\/imprensa\/jsp\/visualiza\/index.jsp?data=01\/04\/2022&amp;jornal=515&amp;pagina=149&amp;totalArquivos=404\">artigo 6\u00ba<\/a> da <a href=\"https:\/\/pesquisa.in.gov.br\/imprensa\/jsp\/visualiza\/index.jsp?data=01\/04\/2022&amp;jornal=515&amp;pagina=149&amp;totalArquivos=404\">Resolu\u00e7\u00e3o ANTAQ n\u00ba 72, de 30 de mar\u00e7o de 2022<\/a>.<br \/>\nArt. 2\u00ba A matriz de risco constante do Anexo desta Resolu\u00e7\u00e3o dever\u00e1 ser utilizada na apura\u00e7\u00e3o dos casos concretos que objetivem identificar o agente respons\u00e1vel pela armazenagem adicional e pelos servi\u00e7os e custos decorrentes nas instala\u00e7\u00f5es portu\u00e1rias, considerando o risco inerente \u00e0 atividade exercida por cada agente. Par\u00e1grafo \u00danico: A matriz de riscos constante do Anexo desta Resolu\u00e7\u00e3o n\u00e3o \u00e9 exaustiva, devendo os casos omissos serem decididos pela Diretoria da ANTAQ.<br \/>\nArt. 3\u00ba Dever\u00e1 ser utilizado o Comp\u00eandio de Elementos da Fiscaliza\u00e7\u00e3o a fim de subsidiar a\u00e7\u00f5es fiscais pertinentes constante no Portal da ANTAQ na internet.<br \/>\nArt. 4\u00ba A<a href=\"https:\/\/pesquisa.in.gov.br\/imprensa\/jsp\/visualiza\/index.jsp?data=01\/12\/2021&amp;jornal=515&amp;pagina=90&amp;totalArquivos=158\"> Resolu\u00e7\u00e3o ANTAQ n\u00ba 62, de 29 de novembro de 2021,<\/a> passa a vigorar com a seguinte altera\u00e7\u00e3o:<br \/>\n&#8220;Art. 30. &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. XLI &#8211; cobrar, exigir ou receber valores dos usu\u00e1rios, quando esses n\u00e3o puderem ser responsabilizados pela armazenagem adicional e por outros servi\u00e7os prestados \u00e0s cargas n\u00e3o embarcadas em navio e\/ou prazo previamente programados na exporta\u00e7\u00e3o: multa de at\u00e9 R$ 250.000,00 (duzentos e cinquenta mil reais); e<\/p>\n<p class=\"dou-paragraph\" style=\"text-align:
